1. The Quick Rule #
Impersonation is a crime, even without financial loss. Under Section 319 of the BNS, “Cheating by Personation” occurs the moment someone pretends to be you online to deceive others. You do not need to prove you lost money; the theft of your “digital self” is enough to trigger legal action.
2. The Legal “Double-Barrel” Protection #
In 2026, victims are protected by two powerful sets of laws:

3. The 2026 “Rapid Takedown” Mandate #
Under the IT Amendment Rules, 2026, social media platforms (Intermediaries) have zero excuses for delays.
- 2-Hour Rule: For highly sensitive content like Non-Consensual Intimate Imagery (NCII) or deepfake nudity, platforms must remove the content within 2 hours of a complaint.
- 3-Hour Rule: If there is a court or government order, the content must be blocked within 3 hours.
- 36-Hour Window: For general impersonation or fake profile complaints, platforms are now mandated to resolve the issue within 36 hours (down from the previous 15-day window).
4. Situation Checklist: How to Kill a Fake Profile #
If you find someone using your photos, name, or voice:
- [ ] Step 1: Preservation of Evidence. Do not just report and delete. Take screenshots of the profile, the “About” section, and any messages sent by the imposter. Save the Profile URL.
- [ ] Step 2: Platform Reporting. Use the “Report Impersonation” tool on the app. Mention the specific IT Rule 3(2)(b) to signal that you know your rights.
- [ ] Step 3: The Cyber Portal. File a complaint at cybercrime.gov.in. If the fake profile is being used for scams, select the “Financial Fraud” category as well.
- [ ] Step 4: Public Warning. Post from your real account to warn your friends and followers. This prevents the “Social Engineering” aspect of the fraud.
- [ ] Step 5: High Court Injunction. For celebrities or high-profile individuals, a lawyer can seek an urgent “John Doe” order from the High Court to block the profile and any “mirror” accounts globally.
5. Special Warning: Deepfakes & Voice Cloning #
In 2026, “Synthetically Generated Information” (SGI) is a major focus.
- Mandatory Labeling: Any platform allowing AI content creation must embed metadata and watermarks. Removing these is a separate crime.
- The “Voice” Scam: If you receive a call that sounds like a family member asking for money, hang up and call them back on their known number. Voice cloning is now prosecuted under Section 319 (Personation) and Section 318 (Cheating) of the BNS.
6. The Official Proof (For Authority) #
“Intermediaries shall deploy proactive technology-based measures… to prevent the hosting of content that impersonates another person or depicts fabricated actions with intent to deceive.”
Section 319 of the Bharatiya Nyaya Sanhita (BNS), 2023:
“A person is said to ‘cheat by personation’ if he cheats by pretending to be some other person, or by knowingly substituting one person for another…”
IT (Intermediary Guidelines) Amendment Rules, 2026:
